Warranty Terms
Manufacturer’s Warranty
Transformer Source guarantees that its supplied equipment will be free from defects in materials and workmanship for a period of two (2) years from the shipment date, unless otherwise specified in the product description. If any equipment is found to be defective within this period, and this is confirmed by the manufacturer, it will be repaired or replaced at the manufacturer’s discretion.
Transformer Source’s responsibility is limited to assisting customers in accessing the manufacturer for repairs and replacements at the manufacturer’s facility, for products that meet the warranty criteria. This warranty is contingent upon receiving written notice of any alleged defects or deficiencies within the warranty period.
Products cannot be returned to Transformer Source without prior approval. Transformer Source is not liable for shipping costs incurred in returning defective items to the manufacturer’s facility, or for the return of repaired or replacement items to the customer.
Transformer Source does not take responsibility or accept invoices for unauthorized repairs to its products, even if they are defective. This warranty applies only to units proven defective under normal use and does not cover improper installation or alteration. Written approval from Transformer Source is required for all returns or repairs.
Transformer Source holds no additional obligations or liabilities concerning the supplied equipment or services rendered. This warranty is void if full payment for the products is not received within sixty (60) days of the shipment date.
Exclusive Warranties
The above warranties are exclusive and replace all other express and implied warranties, except for warranties of title, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Consequential Damages
Notwithstanding any contrary provision herein, TRANSFORMER SOURCE SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, CONTINGENT, OR INCIDENTAL DAMAGES WHATSOEVER.
Returned Goods, Materials, or Equipment
Authorization for return must be obtained from Transformer Source for credit to be issued on all unused goods returned to the factory by the purchaser for their own reasons. In addition to a restocking fee, the purchaser must cover return transportation costs plus refurbishment charges. Transformer Source does not accept returns for credit on used goods or custom-designed or special products.
Before returning any products to Transformer Source, a Returned Goods Authorization Number (RGA#) must be obtained from Transformer Source Customer Service. The following procedures apply:
- Packaging: Products must be appropriately packaged to prevent shipping damage.
- Documentation: All documents and packaging must be clearly marked with the Transformer Source RGA number.
- Freight: Returned products must be shipped freight prepaid by the purchaser.
- Inventory Rotation: An RGA number is required even with an inventory rotation agreement in place.
- Condition: All products returned for credit must be unused and in original condition.
- Eligible Products: Only standard catalog products may be returned for credit. Transformer Source reserves the right to refuse any products returned for credit.
- Charges: All returned products are subject to a minimum 20% restocking fee plus transportation costs.
- Non-Returnable Items: Non-stock, custom, or built-to-order products cannot be returned for credit under any circumstances.
- Inspection: If, after inspection, products returned for credit are deemed defective due to material or workmanship issues and align with Transformer Source’s standard product warranty, full credit may be issued at Transformer Source’s discretion. If products are deemed defective due to customer error or other causes unrelated to Transformer Source’s materials and workmanship, no credit will be issued.
Title
Notwithstanding any contrary provision herein, the title to the equipment remains with Transformer Source until full payment is received by Transformer Source.
Attorney’s Fees
If Transformer Source initiates legal action to enforce the terms of sale or these conditions, or to assert rights related to the sale, the prevailing party in such action, whether at trial or on appeal, shall be entitled to reasonable attorney’s fees to be paid by the losing party, as determined by the court.
